Return and Refund Policy

1.0 Application of this policy

1.1 This Refund Policy relates to your purchase of goods or services on our Website (https://www.itacticali.com) and has been published under our Website Terms and Conditions, which are published here: (https://www.itacticali.com/policies/refund-policy(https://www.itacticali.com/policies/privacy-policy). This policy does not relate to shipping, or to the loss or damage of goods during transit, please see our Shipping Policy at (https://www.itacticali.com/policies/shipping-policy).

1.2 This Refund Policy sets out information about how we process refunds and includes information about your entitlements, obligations, risks, and costs.

2.0 REFUNDS FOR CHANGE OF MIND

2.1 You may return the product/s to us within 30 days after its arrival to your nominated delivery address, in new condition, and in its original packaging, for a refund of the purchase price of that product – note that the refund will not include any amount for shipping, handling, insurance, or other costs.

2.2 To receive a full refund, the product must be returned to us in "new" condition - unused, unaltered, unworn, and containing all original items (e.g., all components of the iTACTICALi ACE Bundle).  

  • We do not refund any shipping charges related to the shipping option you requested at the time you placed your order. All Shipping Insurance purchases are also non-refundable. 
  • You will be charged the cost of the return label (max USD$30). We don't charge a handling fee for the return of defective items.  
  • Discounted items are final and cannot be returned or exchanged.


3.0 Limited rights to refunds

3.1 This Refund Policy describes when and how we will refund the purchase price of new goods or services purchased by you from us. Please read the previous sentence carefully, this means:

a. If you are not the purchaser of a good or service, you cannot request a refund from us;

b. If you purchased our products through a third party, then you cannot request a refund from us for such product;

c. If you purchased a demonstration, second-hand, used, defective product (such as through a scratch and dent sale), or a runout or limited edition good or service from us, then you cannot request a refund from us.

3.2 We will consider requests for refunds only in relation to the following matters affecting our goods or services (please note that the following does not describe circumstances where an exchange is also possible):

a. The description of a good or service was inaccurate or incomplete in some material respect (please note further options under clause 4.1 below);

b. You change your mind or decide that the product does not suit your purposes, and you pay for the shipping of the product back to us in new condition in its original packaging;

c. We deliver the wrong goods to you (please note further options under clause 4.1 below);

d. In relation to sized goods, the size of the goods is incorrect and we do not have a size that is suitable for you in stock or on order;

e. Where you make a valid warranty claim, and we choose to provide a refund at our discretion as described in our Warranty Against Defects, refer to (https://www.itacticali.com/policies/refund-policy) or

f. We are otherwise required by law to provide a refund.

4.0 Exchanges (may cost delivery fee)

4.1 You may request an exchange of a good or service from us within 30 days of the purchase date in the following circumstances without additional cost:

a. We delivered the wrong goods or services (please note that you may request a refund or a replacement at no further cost to you);

b. The description of the good or service was inaccurate or incomplete in some material respect.

5.0 Exchanges (where additional costs apply)

5.1 You may request an exchange of a good or service from us within 30 days of the purchase date in the following circumstances if you pay the additional costs as noted:

a. Where you have purchased a product from us where the size is not correct and we have a size in stock that is suitable, you can request an exchange for that product subject to the product not having been used for anything other than test fitting, and you paying for the return of the product to us in as new condition;

b. Where you have purchased a product from us where the material listed on the care label causes a skin reaction or discomfort on the wearer, which is not common for that material, you may request an exchange of that product if you pay for return shipping of the product to us in as new condition.

RETURN POLICY

If you purchased a product from our website and wish to return it, you may request a refund within 30 days after your order has shipped.  

RETURN INSTRUCTIONS

To return or exchange a product, Contact Us first to talk about your situation. Once your order is identified, we will give you the steps to print a return label. 

REFUND TIMING

Once we receive your return, allow 5-10 business days for the refund to be credited to your account. Your refund will be credited to the same card used to make the original purchase. We'll send you an email when our team has processed your refund so you know it's on the way. 

INTERNATIONAL SALES AND SHIPMENTS

We do sell and ship to customers located outside of Australia. Shipping prices listed at checkout DO NOT include customs charges. We do not cover any taxes, tariffs, or customs charges that might be added to shipments upon delivery. All purchases made outside of Australia are non-returnable. We cannot, and do not refund applicable customs charges or non-Australia taxes or tariffs.  

RETURN THE ITEM FOR STORE CREDIT

If you choose to return an item for store credit, you can choose to receive that credit in the form of a gift card valid for shopping in our store during the returns process. 

WARRANTY

The "Apparels" are not all under warranty. 

We will cover the cost of shipping for defective item returns and replacements. Photo evidence of physical defects might be required to receive a replacement product. 

EXCEPTIONS

The following products cannot be returned for sanitary reasons: 

  • Masks
  • Water bottles
  • Handwarmers
  • Water filters
  • Other apparels

This document applies to all products sold by Aussie Tactical Shop purchased on or after 1 January 2020, except as noted in section 3.2 below.

1.0 Safety Warning and Disclaimer

1.1 Hiking, camping, and other outdoor activities are physically demanding and are subject to various safety risks, inclement weather, and unknown and unforeseen circumstances and MAY RESULT IN INJURY OR DEATH TO YOU AND OTHER PERSON/S. Your participation in outdoor activities of any kind, and your preparation for such activities is your sole responsibility.

1.2 Unless clearly and unambiguously labeled otherwise, each of our Products is NOT A SAFETY DEVICE and is designed only to fulfill a limited purpose. YOU MUST TAKE ALL NECESSARY STEPS TO USE YOUR PRODUCT SAFELY, including reading all use and care instructions. If you have any doubts about the safe use of a Product, we recommend that you take all necessary training and guidance.

1.3 Our Products have parts that may wear over time and are designed to wear in preference to other parts of the Product, or other Products. Examples include but are not limited to guy ropes, straps, groundsheets, carabiners, wear pads, springs, drawcords, tie-out loops, carabiner connector loops, hook and loop items that are not sewn into a product (such as Velcro retaining loops), plugs, toggles, line locks, or those subjected to high loadings, abrasion or rubbing. These parts are not covered by the warranty below, as they are “Consumables” and their lifespan will vary with your use. You are responsible for inspecting and replacing any components and consumables that become worn or damaged prior to each use.

1.4 Consumables and spare parts are available from us, and if you require replacement parts, please visit our website at https://www.iTACTICALi.com, if you cannot find what you need then contact us.

1.5 Modifying a Product may be UNSAFE and will void the warranty.

1.6 PRIOR TO EACH USE: you are responsible for each of the following things:

a. Inspect the Product for wear and damage, and that it is in safe working order;

b. DO NOT USE THE PRODUCT IF it is worn to the extent that it may not work as intended or it may fail during use, or if it is damaged, or it may foul or damage other Products or components, or is otherwise not in Usable Condition.

2.0 The meaning of “Lifetime” in relation to this warranty*

2.1 In this Warranty Against Defects “Lifetime” means the life of the Product while owned by the original purchaser (or the original new product gift recipient of the original purchaser as the case may be). The “life” of the Product will end upon any one or combination of the following events, occurrences, or uses:

a. Where the Product is subject to severe weather-related events, including but not limited to the following :

i. A tropical cyclone, tornado, hurricane, or any wind speed in excess of 90km/h;

ii. Tidal surge, the overland flow of water, or inundation;

iii. Incorrect set-up, which causes more than 1 liter of water to pool in any fabric component for any extended period of time (in any event is more than 2 hours).

b. Where the Product is subject to misuse-related occurrences, including but not limited to the following:

i. Burning, melting, or other damage caused by heat or flame;

ii. Overloading due to overtightening straps, ropes, or forcing components together in a manner other than described in the instructions;

iii. Overloading Products with a stated load capacity (such as hammocks);

iv. Cutting, punching holes, “roughing”, “keying”, making amendments or alterations to, or applying third-party products, substances, or treatments to a Product or any part of it (this does not apply where we direct you to do so in writing);

v. Stretching, fraying, melting, or welding from being overloaded, or subjected to friction;

vi. Grinding, abrading, cutting, scouring, coating, lubricating, cleaning with anything other than mild soapy water (other than as directed), heating (other than as directed), or polishing any metal Product or any part of it;

vii. Painting, using lubricants, or applying other chemicals to the Product;

viii. Inappropriate cleaning or rinsing, which includes without limitation the use of harsh chemicals, steam, or high-pressure cleaning devices.

c. Where the Product is subject to normal wear and tear, including but not limited to:

i. Abrasion from contact with the ground, the environment, straps, belts, cords, and the attachment of devices, tools, equipment, or other accessories to the Product;

ii. Engrained dirt, oil, and other contaminants;

iii. Discoloration;

iv. Fading;

v. Pilling;

vi. Stretching.

d. Where the instructions for use are not followed, and this has caused damage or failure of the Product.

3.0 Warranty Statement

Australian Consumer Law

3.1 If you purchase our Product in Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Warranty against defects

3.2 In addition to your rights under the Australian Consumer Law, we warrant the Product against defects for the Lifetime of the Product, as defined in clause 2 (“Warranty Period”). This warranty does not apply to Consumables, as labelled or as defined in this Warranty Against Defects.

3.3 If our Product is defective and is returned to us by the original purchaser in accordance with the Claim Procedure during the Warranty Period, we will at our discretion replace or repair the defective Product.

4.0 Claim Procedure

4.1 To be eligible to make a warranty claim, you must:

a. be the original purchaser of the Product (or have received the Product new from the original purchaser); and

b. have proof of purchase of the Product (such as a receipt or invoice) from the seller.

4.2 You must fill out our warranty claim form on our website, and supply all required details, in order to make a warranty claim. The warranty claim form sets out the information that we will need to determine how we should respond to your claim.

4.3 Upon receipt of your claim in accordance with this document, we will provide you with instructions on how to return the Product to us. We may require that you send the Product to us by registered post and ensure that the Product is packed to prevent damage from occurring during transit.

4.4 The Product is at your risk until we receive it at our designated service center, and we have no responsibility for the Product being lost or damaged in transit.

5.0 Warranty terms and limitations

5.1 If you send us a Product with a claim for a fault or defect, and we determine that the Product is not faulty or defective, you are liable to pay for any return shipping costs. If you do not pay such costs, after 3 months we may treat the Product as abandoned and dispose of it at our discretion. You consent to us sending you notices by email to the address you provide when you submit your warranty claim.

5.2 Use of modified or third-party components, or making any modifications to the Product (including painting any component of it) will void the warranty.

5.3 We may require that you provide us with certain information to process your warranty claim, including without limitation photos of the damage to the Product, an explanation of how the damage occurred, and the terrain or conditions in which the Product was being used. You agree that we may use this information for assessing your warranty claim and for the future development of our Products.

Glossary of terms

Consumables” has the meaning provided in clause 1.3.

Product” means an Aussie Tactical Shop product that is owned by you.

Usable Condition” means capable of being used safely for the intended purpose.

you” is a reference to the owner of a Product, seeking to make a warranty claim under this Warranty Against Defects.
